Eligibility / Sign Up

To participate in the Program, you must be at least 13 years old. If you are at least 13 but less than 18 years old (or the age of majority in your location), you must also have the consent of your parent or guardian before enrolling in the Program and your parent or guardian must read and agree to these Terms. By enrolling and participating in the Program, you represent that you meet these eligibility requirements.

To begin the enrollment process, you must submit a complete and accurate XSET Rep Program application. Your promotional activity must contain original content and be publicly available via the social media account/website address provided in the application. We will evaluate your application and notify you of its acceptance or rejection. Your Site will not be eligible for inclusion in the XSET Rep Program, and you cannot include any Special Links or Product Advertising Content on it, if your promotional activity is unsuitable. Unsuitable activity include those that:

(a) promote or contain sexually explicit or obscene materials,

(b) promote violence or contain violent materials or promote, endorse or incite potentially dangerous or harmful acts,

(c) promote or contain false, deceptive, libelous or defamatory materials,

(d) promote or contain materials or activity that is hateful, harassing, harmful, invasive of another’s privacy, abusive, or discriminatory (including on the basis of race, color, sex, religion, nationality, disability, sexual orientation, or age),

(e) promote or undertake illegal activities,

(f) are directed toward children or knowingly collect, use, or disclose personal information from children under 13 years of age or other applicable age threshold (as defined by applicable laws and regulations); or violate any applicable laws, ordinances, rules, regulations, orders, licenses, permits, guidelines, codes of practice, industry standards, self-regulatory rules, judgments, decisions, or other requirements of any applicable governmental authority related to child protection (for example, if applicable, the Children’s Online Privacy Protection Act (15 U.S.C. §§ 6501-6506) or any regulations promulgated thereunder or the Children’s Online Protection Act);

(g) include any trademark of XSET or its affiliates, or a variant or misspelling of a trademark of XSET or its affiliates in any domain name, subdomain name, in any “tag”, or in any username, group name, or other identifier on any social networking site (see a non-exhaustive list of our trademarks listed on our Non-Exhaustive Trademark Table); or

(h) otherwise violate any intellectual property rights.

We will determine suitability at our sole discretion. If we reject your application due to unsuitable content, you may reapply at any time once you have complied with our suitability requirements. However, if at any time we 1) reject your application for any other reason or 2) terminate your account in connection with any violation or abuse (as determined in our sole discretion), you cannot attempt to re-join the XSET Rep Program.

Point System

As an XSET Representative, you will earn Points for purchases made by yourself and individuals using your code on www.REPXSET.com. ‘Purchases’ include purchases of regular and sale priced merchandise. If a purchased item is returned, the Points earned by those items will be deducted from the representatives Point total. In addition to earning Points for purchases, reps can also earn Points for certain interactions with us. These include but are not limited to:

- Sign-up Bonus: when you first successfully register as a XSET Representative, we will automatically credit your account with Points as a bonus for joining the program.

- Contests: reps can earn points through contests held within the Rep Program.

- Social Actions: reps can earn points through engaging and interacting with specified social posts or content we share.

XSET reserves the right, in its sole discretion, to change, discontinue, or add the interactions where members can earn Points and the number of Points earned, with or without prior notification to representatives.

All Points earned by members are valid for 365 days from the date of earning and will expire at the end of this period unless XSET explicitly states otherwise. Points are not transferable between reps. Points have no cash value and cannot be exchanged for cash.

Tier System

The XSET Rep Program will have 3 Tiers. Reps can progress through these tiers by earning Points.

XSET REP is the entry-level tier. XSET REPS only need to register for the Program to be part of this tier. No purchase required.

XSET REPs can progress to the higher tiers of XSET FAM and XSET LEGEND by accumulating the required number of Points required within 365 days of registration or current tier entry (your “Membership Year”).

Tier downgrades could happen in two instances:

- If members are in the XSET FAM or XSET LEGEND tier and haven’t met the Points requirements for their tier during their current Membership Year, those members will be downgraded by one tier.

- When a REP returns an order/product and the Points earned from that order/product are deducted, then a member could drop down one tier depending on the corresponding number of Points deducted for the return.

Usage

Members are responsible for maintaining the confidentiality of their password and account and are fully responsible for any and all activities that occur under their password or account. Members should immediately inform XSET of any unauthorized use of their password or account or any other breach of security.
